Uncontested Divorce: Frequently Asked Questions

The questions people ask most before starting a DIY no-fault divorce.

What is an uncontested divorce?
It's a divorce where you and your spouse agree on all the terms — how property and debts are divided, any spousal support, and any parenting arrangements. Because there's nothing for a judge to decide, it becomes largely a paperwork process, which is why it's so much cheaper and faster.
What does "no-fault" mean?
It means neither spouse has to prove the other did something wrong. Instead you state the marriage is irretrievably broken. Every state offers a no-fault path, though the exact wording, and whether a separation period is required, varies by state.
Do I really need a lawyer?
Not necessarily. Representing yourself is called filing "pro se," and it's legal in every state. For a genuinely uncontested case with cooperative spouses, plenty of people handle it themselves. You should talk to an attorney if there's disputed property, contested custody, a business or pension, or any history of abuse.
How much does a DIY divorce cost?
Your main unavoidable cost is the court filing fee, which varies by state and county (commonly a few hundred dollars, with waivers available for low income). Our course is a one-time $47 with lifetime access — compared to $1,500–$5,000+ for an attorney to handle an uncontested case.
How long does it take?
It depends heavily on your state's waiting period and your court's calendar. Some states impose a mandatory waiting period between filing and finalizing. An uncontested case with complete, correct paperwork typically moves as fast as your court allows.
Can I file if we have children?
Yes, as long as you agree on the parenting arrangements. You'll need a Parenting Plan alongside your other paperwork, and courts scrutinize child-related terms more closely. The course covers the Parenting Plan and what judges look for.
Does the course work outside Florida?
The training uses Florida procedure as the working model, and it reveals the methods to complete a no-fault divorce in all 50 states — including how to find your own circuit court clerk's contact information, filing fees, and local procedures. Always confirm your specific court's forms and rules, since they vary.
What if my spouse won't sign?
Then your divorce isn't uncontested, and a DIY course isn't the right tool. When a spouse refuses to cooperate or you can't reach agreement, you're in contested territory — talk to a family law attorney.
What's the difference between the forms, the course, and done-for-you?
Forms give you the documents only. The course gives you the forms plus the training, samples, calculator, checklist, and hearing prep. Done-for-you means a service prepares the paperwork for you at a higher price. See the full comparison.
